These Terms and Conditions ("Terms") apply when you use our website and, where applicable, when you purchase products or services from us.
Please read these Terms carefully before using our website or placing an order.
Nothing in these Terms affects any rights you have under UK consumer law.

2. Using our website
You may use our website only for lawful purposes.
You must not use the website:
- in breach of any applicable law or regulation;
- fraudulently or for any unlawful purpose;
- to transmit viruses, malware or other harmful material;
- to interfere with the operation or security of the website;
- to obtain unauthorised access to our systems or those of another person;
- to collect personal information about others unlawfully; or
- in a way that infringes our intellectual property rights or the rights of another person.
We may restrict or suspend access to the website where reasonably necessary, for example for security, maintenance or where we reasonably believe the website is being misused.
3. Information on our website
We take reasonable care to ensure that information on our website is accurate and up to date.
However, website content is provided primarily for general information and may occasionally contain errors or become out of date.
Product descriptions, specifications, installation information and other important information should be read together with any instructions or documentation supplied with the relevant product.

Nothing on the website is intended to replace professional advice where professional advice would reasonably be required for a particular installation or application.
4. Products
We aim to describe and display our products as accurately as reasonably possible.
Product images are for illustrative purposes. Colours and appearance may vary slightly depending on your device, screen settings, lighting, natural variation in planting material where applicable, or normal manufacturing variation.
Measurements, dimensions and specifications shown on the website will be stated as accurately as reasonably possible. Where an exact measurement or characteristic is important for your intended installation, please check the relevant product information or contact us before ordering.
We may update product designs, specifications or packaging from time to time, provided this does not materially reduce the quality or functionality of a product already ordered.
5. Prices
Prices shown on our website may change from time to time.
The price displayed when you place your order is the price payable for the product, subject to the provisions below concerning obvious pricing errors.
Delivery charges, where applicable, will be shown separately before you place your order.
Changing a website price does not affect an order that we have already accepted, except where the price displayed was clearly incorrect and the error should reasonably have been apparent.
We take reasonable care to ensure that product prices are correct. If we discover a pricing error after you place an order, we will contact you before accepting or fulfilling the affected order and give you the opportunity to proceed at the correct price or cancel.
6. Placing an order
When you place an order through our website, you are making an offer to purchase the products in your basket.
After receiving your order, we may first send you an acknowledgement confirming that we have received it. An acknowledgement of receipt does not necessarily mean that we have accepted your order.
A binding contract between you and LivGrid is formed when we send you an order confirmation confirming that your order has been accepted.
We may be unable to accept an order, for example because:
- a product is unavailable;
- we cannot authorise your payment;
- there has been an obvious pricing or product-description error;
- we cannot deliver to your location; or
- we reasonably suspect fraud or unlawful activity.
If we cannot accept your order, we will tell you and will refund any payment we have taken for that order.
We will not refuse an order for an unlawful or discriminatory reason.
7. Payment and account information
You must provide complete and accurate information when placing an order.
If you create an account, you are responsible for keeping your login details secure and for telling us promptly if you believe somebody else has obtained unauthorised access to your account.
Available payment methods will be shown during checkout.
Payment processing may be provided by third-party payment providers. Your payment information will be handled in accordance with the relevant provider's terms and privacy arrangements as well as applicable data protection law.
8. Delivery
Available delivery methods, charges and estimated delivery times will be shown on the website or during checkout.
We will deliver products to the address you provide when ordering. Please check that the delivery information is correct before completing your order.
Unless we agree otherwise with you, goods purchased by consumers will be delivered without undue delay and normally within 30 days after the contract is entered into.
Occasionally delivery may be affected by circumstances outside our reasonable control. If this happens, we will contact you where appropriate and take reasonable steps to minimise the effect of the delay.
Your statutory rights are not affected.
9. Your right to cancel an online order
If you are purchasing as a consumer, you will normally have a legal right to change your mind and cancel an online order within 14 days, subject to the exceptions provided by law.
For most goods, the cancellation period ends 14 days after the day on which you, or someone nominated by you, receives the goods.
To cancel, you must tell us clearly that you wish to do so. You do not have to give us a reason.

After telling us that you wish to cancel, you will normally have a further 14 days to return the goods.
You may handle goods to the extent reasonably necessary to establish their nature, characteristics and functioning, in the same way you would normally be able to examine them in a shop. We may be entitled to make an appropriate deduction from a refund where the value of goods has been reduced by handling beyond this.
Where you exercise a statutory cancellation right, we will provide any refund due in accordance with applicable consumer law, including the cost of standard delivery where required by law.
Certain goods and services may be excluded from the statutory cancellation right. Where an exclusion applies, we will make this clear before you place your order.

10. Faulty, damaged or incorrectly described products
Nothing in these Terms limits your legal rights if goods are faulty, damaged, not as described or otherwise fail to meet the requirements of applicable consumer law.
If you believe there is a problem with a product, please contact us at hello@livgrid.co.uk with your order details and a description of the issue.
Your rights in relation to faulty goods are separate from, and may extend beyond, the 14-day cancellation right described above.

11. Third-party services and links
Our website may contain links to websites, services or tools operated by third parties.
These links may be provided for convenience or to provide additional information. Unless we expressly state otherwise, the presence of a link does not mean that we operate, control or endorse the third-party website or service.
Third-party websites and services have their own terms and privacy policies. We are not responsible for their content or operation where they are outside our control.
12. Reviews, photographs, comments and other submissions
If you send us a review, photograph, suggestion, comment or other material, you remain the owner of any intellectual property rights you have in that material.
Where you submit material specifically for publication, promotion or use by LivGrid, you give us a non-exclusive, royalty-free licence to use, reproduce and display that material for those purposes.
We will not knowingly publish content that is unlawful or infringes another person's rights.
You must only submit content that you have the right to share with us.
Where personal information is included in submitted content, our use of that information is also governed by our Privacy Policy.
13. Intellectual property
Unless stated otherwise, the website and its content, including text, graphics, branding, photographs, illustrations, designs and other materials, are owned by or licensed to LivGrid and are protected by applicable intellectual property laws.
You may view and print reasonable extracts for your own personal, non-commercial use.
You must not reproduce, commercially exploit or redistribute substantial parts of our website or content without our prior permission, except where permitted by law.

15. Our responsibility to you
We do not exclude or limit our responsibility where it would be unlawful to do so.

- any matter for which liability cannot legally be excluded or limited.
If you are a consumer, we are responsible for losses that you suffer which are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
Unless we expressly agree otherwise, products sold to consumers are supplied for domestic and private use. If you use products for commercial or business purposes, different terms may apply.
Nothing in this section affects your statutory rights as a consumer, including your rights in relation to goods that are faulty, not of satisfactory quality or not as described.
16. Your responsibility
You are responsible for using products in accordance with the instructions and information supplied with them and for ensuring that your proposed use is suitable for your circumstances.
Where installation requires assessment of a wall, structure, fixing method, water supply, drainage, electrical equipment or another site-specific factor, you are responsible for obtaining suitable professional advice where reasonably necessary.
Nothing in this section reduces any responsibility that LivGrid has under applicable law for the products or services we supply.
17. Changes to our website or these Terms
We may change or update our website from time to time.
We may also update these Terms to reflect changes in our business, services or applicable law.
The version of the Terms that applies to an order will normally be the version made available to you when you placed that order. We will not retrospectively change an agreed contract in a way that unfairly disadvantages you.
The latest version of these Terms will be available on this page, together with the date on which it was last updated.
18. If part of these Terms is unenforceable
If a court or other competent authority decides that any provision of these Terms is unlawful or unenforceable, the remaining provisions will continue to apply.
19. Delays outside our reasonable control
We will not be responsible for a delay or failure to perform an obligation where that delay or failure results from circumstances outside our reasonable control.
Where such circumstances materially affect an order, we will contact you as soon as reasonably possible and take reasonable steps to reduce their impact.
This does not affect any right you may have under consumer law to cancel an order or receive a refund.
20. Governing law and disputes
These Terms are governed by the laws of England and Wales.
If you are a consumer, this choice of law does not deprive you of any mandatory legal protection that applies to you in the part of the UK where you live.
If you live in England or Wales, you can bring legal proceedings in the courts of England and Wales.
If you live in Scotland, you may normally bring proceedings in the Scottish courts.
If you live in Northern Ireland, you may normally bring proceedings in the courts of Northern Ireland.
